Elder Law & Disability Planning

The Firm’s attorneys provide legal services that are tailored to the unique needs of senior citizens and disabled clients. Our comprehensive planning includes:

  • Long term care planning and counseling.
  • Institutional Medicaid planning. The Firm helps clients navigate the Medicaid application process, and focuses on the intricacies of the Five (5) year Look-Back Period. Strategies include the use of Irrevocable Asset Protection Trusts (also known as Medicaid Income Only Trusts), and Spousal Refusal to protect a client’s home and savings.
  • Community Medicaid. The Firm is experienced in assisting disabled people to be able to remain in their homes while receiving care from Medicaid-provided health aides. In such cases, the Five (5) year Look-Back Period does not apply, and the client’s income may be afforded protection with the use of a Pooled Income Trust.
  • Powers of Attorney and Health Care Proxies are essential to a successful long-term care plan.
  • Guardianships
  • Life Estate Deeds
  • Irrevocable Asset Protection Trusts
  • Promissory Note/Gift planning strategies.

Many people are faced with the challenge of providing care for a disabled parent, spouse, child or grandchild. The attorneys in the Firm address these concerns by implementing various disability trusts, such as third party supplemental needs trusts and pooled income trusts. The attorneys also prepare special needs trusts for victims who receive personal injury awards or settlement proceeds.
